He was born on February 15, 1959 in Washington D.C. and was raised in Jewish family. His mom worked as an art critic and his dad was a psychotherapist. He graduated summa cum laude from Princeton University with an A.B. in philosophy in 1980 and magna cum laude from Harvard Law School with a J.D. in 1986. He is married to Yale Law School professor Amy Chua, author of the books World on Fire and Battle Hymn of the Tiger Mother and lives in in New Haven, Connecticut. They have written a book together, the title of the book is: The Triple Package: How Three Unlikely Traits Explain the Rise and Fall of Cultural Groups in America. They have two daughters together.

He has studied drama in the theater section of Juliard school some where in 1980. He was a clerk under judge Joseph T. Sneed on the United States Court of Appeals for the Ninth Circuit in 1986–1987. After finishing his experience as clerk he worked as an associate at Wachtell, Lipton, Rosen & Katz and as an assistant U.S. Attorney in the Southern District of New York. He is an expert on constitutional law, privacy, and the First Amendment. In 1990, he became a teacher at the Yale Law School and was appointed to a full professorship in 1994. Rubenfeld has also taught as a visiting professor at both the Stanford Law School and the Duke University School of Law. He is also the author of two successful novels.

In 2018, Rubenfeld had been put under investigations by Yale Law School for allegations of sexual harassment and inappropriate conduct, particularly towards female students. The Title IX investigator Jenn Davis had conducted this investigation. Both him and his wife Amy Chua were accused of the misconduct. He has been on leave since spring of 2018 and was suspended from teaching in August 2020 for two years and, upon returning, will be barred from teaching small groups of students or required courses. In 2020 the student body had asked Rubenfeld to be removed by the Yale university permanently.
