Vaiko was imprisoned for 40 days on charges of organizing a black flag rally against former Prime Minister Indira Gandhi’s visit to Tamil Nadu in October 1977, and for more than a year in 1976–1977 during the Emergency.  He has been detained numerous times for protests, particularly during the anti-Hindi agitations in 1986–1987.

He was elected to the Rajya Sabha in 1978 and has served three terms in the Upper House. Additionally, he was thrice elected to the Lok Sabha. Vaiko founded MDMK in 1993 as a result of disagreements with Karunanidhi. Due to his vehement remarks in Parliament, Vaiko earned the nickname “Lion Of Parliament.” Vaiko objected to Kerala’s proposal to build dams in Siruvani and Pambar as well as its demand for a new dam at Mullaperiyar. Vaiko also backed the construction of the Sethusamudram Shipping Canal and national river interconnection. Vaiko filed a Public Interest Litigation (PIL) in the Madras High Court asking that Sterlite Industries’ copper smelting factory in Tuticorin be shut down because it did not adhere to proper waste management protocols, which ultimately caused the shutdown of the plant.

Vaiko frequently leads party members on foot marches to draw attention to problems. Vaiko openly backed the LTTE and other groups battling for a separate Tamil Eelam state in Sri Lanka. He visited Eelam in 1989 during the height of the conflict between the LTTE and the Sri Lankan Army, while the IPKF Indian Peace Keeping Force was stationed in Jaffna. Vaiko was the country’s first detained person under the Prevention of Terrorism Act of 2002 and the leader of a recognized political party. After serving 18 months in jail, he was freed.

Vaiko openly backed the LTTE and other groups battling for a separate Tamil Eelam state in Sri Lanka. Vaiko was detained by the Criminal Investigation Department of the Tamil Nadu police in 2008 on seditious allegations. The accusations came from remarks Vaiko made about the Sri Lankan issue and the government’s raids into LTTE-held territories on October 21, 2008, at a party meeting. Vaiko was released from detention after 14 days. According to Vaiko, India should lift its embargo on the LTTE because it was used as a shield to repress free speech and the voice of the opposition.

Vaiko was imprisoned on April 3, 2017, as a result of a DMK-filed sedition prosecution from the 2010 administration. Vaiko’s lawsuit alleges that India’s sovereignty has been violated. Vaiko was given a jail sentence in 2009 and served 56 days of that sentence. Vaiko was given a one-year prison term and a $10,000 fine. Vaiko filed an appeal against the ruling a few days after it was rendered. Judge Adikasevalu ordered the suspension of Vaiko’s sentence after hearing his appeal.
